A panel discussion in Malaysia included a discussion of whether tax incentives for Islamic finance should be continued (they were first introduced in 2004//05).? Some of the tax incentives are provided to make Islamic finance competitive with conventional finance, and these should eventually be phased out, so that Islamic finance focuses on its competitiveness and offering customers with a valuable product (rather than developing sophisticated political power to entrench the tax incentives).?

On the other hand, incentives that place Islamic and conventional finance on equal footing should be maintained.? For example, eliminating double taxation where the structure of an Islamic financial product would lead to extra taxation compared to a similar conventional product that would be subject to lower taxes.

There is certainly a role for both placing Islamic finance on equal ground with conventional finance, as well as providing temporary incentives that allow Islamic financial institutions to grow to a scale that makes them more competitive, where they can spread costs across a larger institution and minimize the cost gap with conventional financial institutions.? However, Islamic finance now makes up more than 20% of the banking industry in Malaysia, so it might be time to start phasing out the subsidies (tax incentives) that solely benefit Islamic finance without addressing some inequality (e.g. double taxation of Islamic products).?

Surfers Against Sewage believe that climate change poses a major threat to recreational water users, the marine environment and the global environment as a whole, and agrees that action needs to be taken to combat it. Surfers Against Sewage supports the advancement of renewable energy sources, but will examine each new development on a case-by case basis in order to assess any potential negative impacts on coastal environments, surfing resources and recreation.

The Rampion Offshore Wind Farm is a proposed wind farm in the English Channel. If the Rampion proposal is to be developed it would sit inside an area of approximately 167 square kilometres. Inside that expansive sea area there could be a maximum of 195 three MW turbines. These would be spread out throughout the proposed area.? The developers claim the Rampion proposal could power up to 450,000 homes with sustainable energy.

Surfers Against Sewage (SAS) is extremely concerned with E-ON?s Draft Environmental Statement identifying potentially significant negative impacts on wave height of up to -22% at Brighton Marina and surf spots to the east of the city, which are some of the country?s most popular and well established surfing beaches.? This potential reduction would be an unacceptable level to SAS and the local surfing community. ?You can view SAS?s official response here:

Surfing and other wave-related sports (stand up paddle (SUP) boarding, kite surfing, wind surfing and kayaking) are incredibly popular in Brighton, and along the south coast.? Even though this stretch of coastline generally receives low quality surf, it is of high importance to a vast number of people and the local community.? These high value/low quality waves are also more sensitive to changes.

The mitigating action proposed in the Draft Environmental Statement, table 19-10: Summary of Residual Effects and Mitigation Measures is ?Consultation with stakeholder groups.? No other mitigation proposed.?? This is unacceptable.? Consulting stakeholder groups about a significant reduction in wave height and therefore wave quality is not mitigation.? It will do nothing to reduce the significant impact on the wave height expected in Brighton and along the south coast.? Surfers Against Sewage have called for more information on how altering the turbine layout, size, numbers, placement, anchorage and any other mitigating actions could help reduce the potential negative impacts on surfing wave height.

Surfers Against Sewage has requested urgent discussions with E-ON to discuss the projected impacts on the surfing wave resource, associated socio-economic ramifications and to identify meaningful mitigating actions to safeguard Brighton?s surfing assets.

Surfers Against Sewage is also concerned that the impacts of a 22% reduction in wave height have not been investigated in the socio-economic studies within the Draft Environmental Statement.? Participants in surfing and other surf related sports help support a variety of businesses along the south coast.? Obviously surf shops, surf school and surf related businesses could be directly impacted by a loss of surfing days, as could hotels and B&Bs, cafes and restaurants.? There is evidence to suggest that surfers spend 8% more than the average coastal visitor. SAS?s Waves Are Resources Report (2010) details how surfers spending habits help support the wider community.? The Waves Are Resources report has been repeatedly referenced within the Draft Environmental Statement in relation to the quality of Brighton & south coast surfing waves, however, E-ON has completely failed to reference socio-economic information or undertake any further research in this area.?? A 22% reduction in wave height has the potential to cause a loss of surf related jobs in the affected areas.

Surfing is also of significant social and cultural importance along the south coast, nowhere more so than in Brighton itself.

Again SAS has requested an urgent meeting with E-ON to discuss these omissions from the Draft Environmental Statement and establish what remedial action will be implemented.

Surfers Against Sewage has contacted the Planning Inspectorate to be registered as an interested party when the Environmental Statement is submitted.? This will ensure that when E-ON submit their final Environmental Statement in December 2012 SAS will be a recognised stakeholder and be best placed to officially represent water users on this development.

Israel conscript law expires

An Israeli law which allowed ultra-Orthodox Jews to defer military service is to expire on Tuesday, leaving a legislative hole which could technically see them called up en masse.

When the Tal Law expires at midnight, conscription will theoretically be guided by a 1986 law, meaning that all 18-year-old Israelis, including the ultra-Orthodox, will be compelled to enlist -- unless they are specifically exempted by the defence ministry.

However, Defence Minister Ehud Barak on Tuesday afternoon gave the military some breathing space to work out how to put the theory into practice.

"Barak has instructed the Israel Defence Forces to submit, within about a month, a practical proposal for implementation of the Security Service Law on the youth of the ultra-Orthodox community," a statement from his office said.

"This is until the Knesset (parliament) approves new legislation regularising the issue permanently."

In February, Israel's High Court ruled the Tal Law was unconstitutional and must be rewritten, prompting calls for a system to impose conscription or some other form of national service on the ultra-Orthodox as well as on Israel's Arab minority.

But the question of how to reword the law has sparked deep divisions in the rightwing coalition of Prime Minister Benjamin Netanyahu, which failed to push through new legislation before the parliament broke up for its summer recess.

The centre-right Kadima party pulled out of Netanyahu's ruling coalition two weeks ago, just 70 days after joining it, saying his draft legislation did not go far enough.

Party leader Shaul Mofaz said he was pulling out over Netanyahu's refusal to accept the conclusions of a committee headed by Kadima MP Yohanan Plessner.

The departure of the 28-seat party, the largest in the 120-seat parliament, reduced Netanyahu's overwhelming majority of 94 to 66 MPs.

Israel's Arab youth have traditionally been exempted from military or national service by means of an unwritten Israeli policy.

But when parliament reconvenes in October after its summer break, attempts to push through fresh legislation compelling both Arabs and the ultra-Orthodox to complete some form of service, are likely to begin again in earnest.

A platonic relationship is one that exists between a man and woman that is devoid of any sexual intimacy; being friends without benefits, as it is known today. Is it unrealistic to think that a man and woman can maintain a purely non-sexual relationship? I believe they can if, and only if, those feelings that first attracted them to each other do not evolve into deeper, more romantic feelings. That seems like stating the obvious, but the point we need to keep in mind is that the attraction between a man and a woman may have different motives. For example, a woman might be initially attracted to a man's good looks, and a man may say it is the same for him, except for the fact that his attraction would be heavily influenced, or driven, by his male sexuality, the sensual aspect of his physical attraction to the female. If, however, the man is not physically attracted to the woman, the chances are better that a platonic relationship can be sustained. However, even if their relationship is based on mutual attraction without sexual overtones, the possibility of a platonic relationship maturing into a romantic one still exists. The feelings of closeness, resulting from intimate conversations, can easily blossom into a romantic relationship right under their noses, without either one knowing or recognizing the change. And, once that occurs, the inevitable sexual intimacy follows and the platonic relationship ends and the romantic relationship begins.

A few indicators of crossing the line between platonic and romantic relationships include: greeting each other with lingering hugs and kisses; frequenting the same restaurant and having intimate conversations over dinner, holding hands while walking; maintaining contact with each other throughout the day and before going to bed, via text messaging or cell phone. Behaviors such as these are not platonic, they are intimate. Because neither party has made sexual advances doesn't mean they won't do so when the time is felt to be right, and when it does happen, more than likely it will have been instigated by the party who initiates the dance of seduction.

It's a fact that most relationships begin as platonic but quickly take a different turn if the individual is driven by romantic motives from the very beginning. A man and woman may start their relationship on a platonic level with one or both maintaining a cautious attitude as they explore each other's nature and personality. Eventually, if their mutual attraction grows stronger, they will raise the level of their relationship to a romantic one. Most people joining social network sites are looking for deeper relationships than just platonic and, as long as each party knows what is expected, these avenues of social interaction can be very fulfilling, of course with the caveat that one takes the necessary precautions inherent in interaction on a website.

Katherine Jackson Speaks Out: I'm Fine!


Katherine Jackson has spoken out for the first time since she abruptly left her home in California for a supposedly doctor-recommended vacation in Arizona.

Considering the 82-year old mother of Michael Jackson, and legal guardian of his three kids, did not speak to her grandchildren during her time away, there's been talk that Katherine was taken/held against her will.

But she claims that wasn't the case.

"There are rumors going around about me that I have been kidnapped," Jackson told ABC News. "I am here today to let everybody to know that I am good and fine. My children would never do anything to me like that."

But would they? Perhaps if they were upset over MJ's will and hoping to use Katherine to challenge its authenticity?

Why did Katherine leave three young kids at home without supervision? Reading from a script and sounding confused, she said she just needed a "short vacation," adding: "One reason I didn't call is I just gave up my phone and I didn't want to have any phone calls while I was here."

So... she simply abandoned 14-year old Paris Jackson and her two siblings? It's a VERY odd, likely very sordid situation.

"I am devastated that while I've been away, my grandchildren have been taken away from me, and I'm coming home," Katherine concluded.

In the meantime, TJ Jackson has been named temporary guardian of Paris, Prince and Blanket.

Viagra has dramatically altered the entire dating landscape. The sex lives of the young, middle-aged and the old will never be the same.

Take young men. No longer must a young man be worried about his performance or about having a few drinks before "hooking up." He can pop a little pill at the beginning of the evening and relax, knowing that he is prepared for any conquest that may come his way.

On the other end of the timeline, there are the young women who marry old guys for their money. In order to fulfill their part of the deal, it used to be that the girls did not have much to worry about in the sex department -- they just needed to be sweet "arm candy." Now, with the invention of sexual performance drugs (SPD's), these women have their work cut out for them.

Having re-entered the dating scene at fifty after a traumatic divorce, I wondered how this pill would affect my age-group. Was it a topic of discussion on a date? Was it prevalent? Should I bring it up at some point? What I discovered was that the men who relied on SPD's were still conflicted as to whether or not to hide their dependence on them. They did not want to be viewed as "old men" who had lost some of their mojo. But in reality, if they needed pharmaceutical assistance, they surreptitiously popped a pill just in case.

But one man who I dated was not quite so cool. I was fixed up with a very handsome sixty-year-old commercial artist. He was tall and fit with beautiful white hair. He had many of the same interests as I did, so we began a comfortable dating relationship. We took walks in the park with my golden retriever. We took long drives along the beach and then had a relaxed dinner. We went to the movies and spent quality time together.

After awhile, we had a clear connection and it was time for the next phase -- a sexual relationship. But rather than make a move or talk about it, he simply asked, "Should I take my Viagra yet?"

Taking a pill was fine with me. That is why they are on the market, after all. The problem was the question itself. It seemed so cold and calculated and unromantic. And why not just take the pill and see what played out over the course of the evening? Asking made me the decision-maker as to whether or not we were going to have sex, and that ruined a lot of the spontaneity and fun.

When I questioned him as to why he asked, he explained that each pill cost $10 and he did not want to waste the money. That was the worst possible answer that he could give, and it ruined any interest that I had in pursuing any sort of relationship with him.

So what is the proper etiquette for taking a pill? If a man decides to take SPD's, that is his decision and the pill should be taken privately on his own schedule. Even after the pill is taken, it does not have to be acted upon. That preserves the spontaneity as well as the fun. It does not become a pharmaceutical mandate. I certainly want to believe that it is I who is turning him on. Maybe later in the relationship the subject can be more freely discussed, but in the beginning, I vote for romance any day.

Peace Corps and Afghanistan ? ZERO ANTHROPOLOGY

The information and discussion about the activities of and the accumulation of various forms of capital by some Peace Corps Volunteers (PCVs)?all in South America?is interesting (Anthropology News, December 2011, March 2012). President John Kennedy adapted the blast ?ask not what this country can do for you, ask what you can do for this country? from his prep school headmaster?s command ?ask not what this school can do for you, ask what you can do for this school?.

The predecessor of the American Peace Corps (PC) project was the ?Community Development? (CD) model housed in several American universities funded by the government and designed to coordinate various ?development? projects in foreign countries and to cloak the real intentions of the American ?foreign aid? program which was intervention in and control of the civil and political societies of the ?Underdeveloped World?. During the 1950s the University of Wyoming was engaged in such a project in Afghanistan. In early 1960s Michigan State University was deeply involved in community development projects in Cambodia, Laos, and South Vietnam. The MSU anthropology/sociology and political science departments and its School of Police Administration were leading participants in these programs. Wesley Fishel (political science) and John Donoghue (anthropology) were some of the MSU faculty I remember who were involved in course offerings and field projects connected to community development.

The Peace Corps was clearly an instrument of American post-WWII imperial stretch and Cold War strategy designed to undermine the presence and influence of the Soviet Union in ?Third World? countries especially those constituting the ?non-aligned? movement (led by Nasser, Nehru, Nkruma, Sukarno, and Tito) of which Afghanistan was a charter member. The American rage and hubris-driven imperial apparatus is a master of destruction, fragmentation, division, and separation. During the past sixty five years everything touched by this machinery (and its layers of real or imagined fear??we are about to be hit?) has turned to dust?from the Middle East (except Israel) to Korea to Southeast Asia to Iran to Cuba to Afghanistan to Iraq to Somalia to Yemen to Middle and South America. Afghanistan, Iraq, and Palestine are the most devastated and bloodied victims of this imperial stupor. This frustrated and stupefied American imperial disposition was consolidated and its components fitted with various cloaks during the 1960s. Its Peace Corps component was masked with a smile and equipped with elementary competence in local culture and spoken language of the Other?pamphleteer history and culture and nutshell colloquial Kabuli Farsi in the case of Afghanistan?essentially what the Human Terrain System currently provides its participants headed to camping out in Afghanistan. It would be interesting to systematically study the history and political and ideological moorings of the PC programs and operations in countries like Afghanistan, Egypt, Ghana, India, Iran, and Pakistan.

The anthropologist Louis Dupree, the famous authority on Afghanistan with known CIA connections (Senate 35[52]: S4649-S4950, 1989), has written a chapter about PC in Afghanistan in Robert Textor?s 1966 Cultural Frontiers of the Peace Corps. The first group of PCVs arrived in Afghanistan during late 1962. Over the next decade the program expanded and stabilized into a level of comfort resembling the ease of thousands of Euro-American hippies who had found themselves scattered throughout Afghanistan and crowded into Kabul on their way to the spiritual highlands of northern South Asia.

Peace Corps operations in Afghanistan were terminated after the Kabul government was overthrown by the Khalq revolution in 1978. This and the 1979 Islamic Revolution of Iran intensified the level of frustration and rage in the American imperial hubris. To my knowledge only one PCV converted the Afghan experience into an MA and PhD in anthropology. During summer 1965 I served as an assistant to the area studies component of the PC training program for Afghanistan at the University of Texas, Austin. I remember constant whisperings about the CIA involvement in this and previous Afghan PC programs and the connection of some of its staff to the US intelligence agencies.

One of the Peace Corps Volunteers who spent years in Afghanistan and who was deeply devoted to, inspired by, and worked closely with Dupree was Thomas Gouttierre, current director of the popular Afghanistan Studies Center (ASC) at the University of Nebraska-Omaha Gouttierre has testified numerous times during the last three decades before the US congress on behalf of continued American intervention in Afghanistan.

?Peace Corps volunteers host a ?Hootenanny? for Afghan orphans (Kabul, 1965)?. Craig Shulstad entertains children with songs, while Thomas E. Gouttierre (just behind Shulstad?s right shoulder, looking down at the ground) stands next to his wife Marylu (sunglasses, to the right of Shulstad?s left shoulder).

The ASC housed the Afghanistan Studies Association (ASA) during the early 1970s and I served as its president during 1973-74 totally unaware of its ideology and political connections and activities. In retrospect the ASA served as an academic cloak for ASC. Gouttierre was the self-appointed secretary of ASA throughout its life course. Other PCVs with experience in Afghanistan who have been associated with the ASC at UNO include Christian Jung, David Champaign (currently advisor to the US military). The close connection between the ASC and CIA and other US government military and civil operation has been recently publically aired at UNO. Currently ASC works closely with the US Army?s Human Terrain System programs in Afghanistan. (See anthropologist John Allison?s report on Zero Anthropology.) The textbooks currently used in the schools of Afghanistan are produced by ASC. The center has maintained extensive ties with US military and intelligence operations in Afghanistan for the past 35 years. The ASC staff have produced several studies about the mineral resources of Afghanistan (e. g. works by Christian Jung, and Jack Shroeder).

Several US educated Afghans who have worked with the PC training programs as language instructors have become prominent members of the American occupation program in Afghanistan??Brown Skins with White Masks?. Mohammad Esmael Burhan, PhD University of Texas in linguistics, is currently a senior staff member at ASC. Ehsan Entezar, a favorite of PCVs for his legendary Kabuli attitude and humor, has written ?Afghanistan 101?, a fixture in virtually all American government libraries. Hedayatullah Aminarsala, currently the chief Kabuli advisor to Hamid Karzai, taught Farsi in several PC training programs for Afghanistan during the 1960s. His wife, Betsey Thomas, was a PCV in Afghanistan during 1965-67.

The number of PCVs with service in Afghanistan and associated with the American military and political operations in the country is difficult to determine. But based on what I have been told and what an educated guess suggests, scores of PCVs with experience in Afghanistan have participated in the American occupation machinery of Afghanistan. The impact of the attempted Euro-Americanization of Afghanistan by PC is not easy to gauge. However, some of this effect speaks for itself in the rubble of the state format of Afghanistan caused largely by the dark minded rage of the American imperial warfare machinery?the ideological and material parent of the so called ?Peace Corps?.

Mountain Lion is basically a way for Apple to bring its mobile and desktop operating systems closer together. Now your iPad, iPhone and Mac will get along better than ever.?Your documents, notes, calendars,?messages, reminders, Safari tabs and more will?sync across devices smoothly thanks to Mountain Lion. (And things will get even cozier when iOS 6 arrives in the fall, of course).

  • Messages: Thanks to the new Messages app?? which replaces iChat?? you can sync your iMessage conversations across devices. Start a conversation on your MacBook Air, continue it on your iPhone, and then wrap it up from your iPad. You only have to sign into the services once, within the "Mail, Contacts & Calendar"section of your settings, and you'll be all set to go. You'll be able to tweet or post to Facebook using the Share menu found in many Mountain Lion apps as well ??and even from a special box at the top of the Notification Center.

Your Facebook friends and Twitter contacts can be imported directly into your contacts as well, so you can always have up-to-date info on your pals. Birthdays listed on Facebook profiles can also be automatically added to your Calendar.

You'll also be able to get alerts or banner notifications for status updates from?either social network.

Thanks to AirPlay mirroring, you can wirelessly send whatever's on your Mac to an HDTV, via the $99 Apple TV box. A quick pinching gesture will reveal a new tab view, which will allow you navigate between open (and live) tabs by swiping back and forth. This may not sound like much, but it is quite possibly one of our favorite little tweaks in Mountain Lion.

The big little things
There are a lot of features and changes?within Mountain?Lion which you won't even realize exist until you really need them for a task or stop to think about why something "just works." They're the big little things that make life simpler or more fun.

  • Game Center -?Mountain Lion has a Game Center app now, meaning that you can track leaderboards, compete against friends, receive game notifications, and more. Just like in iOS.
  • Dictation - Wherever you'd normally type, you can now talk. Just select a text field and tap a keyboard shortcut to start the dictation feature. Mountain Lion will understand you fairly well and even get what you mean when you say "all caps," "new paragraph," or "comma."
  • VIPs -?You can tell Mountain Lion which people are most important to you by marking them as "VIPs." This will make their messages rise to the top of Mail and allow you to set separate notifications for these important individuals.

Will this kitten scratch?
As with any operating system update, it's not all sunshine and snuggles when it comes to Mountain?Lion.?Some folks?will feel as if all the little changes don't add up to a decent upgrade; others will be disappointed that Mountain?Lion isn't a perfect mirror of iOS for the desktop, and so on.

But let's be realistic: You're paying $19.99 for an operating system upgrade which contains over 200?new features. Yes, some of them are minor, but there is some strength in numbers. And besides: You'll have an excuse to make purr-fectly?silly?cat-themed puns?after updating.?

Convinced that this is the update for you? Great! There are a few things you should do before rushing off and attempting to download Mountain?Lion though:

  • Check if your computer can handle Mountain Lion. You should be running OS X 10.6.8 or higher, have 2GB of memory and 8GB of available space. (You should be using recent Mac model. Check this list to see if yours is supported.)
  • Update your third-party apps. Odds are that many of your favorite apps will get updates to make them compatible with Mountain Lion, so just go ahead and take care of those now.
  • Backup your files. We can't emphasize the importance of backing up your files enough. Plenty of things can go wrong on an ordinary day, but you're just asking for trouble if you're upgrading your operating system without a backup.

Notice - Minyanville

MINYANVILLE ORIGINAL The first two installments described the creation of quantitative tools to optimize individual risk taking, and the adoption of those tools by financial regulators to set bank capital standards. To the rocket scientists who invented the methods, "capital" was an intangible used to manage risk of an individual risk taker. To economists and regulators, "capital" was an excess of assets over liabilities that ensured liabilities could be paid even if assets declined in value. It was defined at the level of the entire regulated institution, not individual risk takers.

To makes this more concrete, think of the question: How much capital does it take to support a new business idea? Clearly there are a variety of answers. With minimal capital, an innovator might build a prototype by hand in his or her garage on weekends, then use it to get a single customer to order ten units, for which production could be outsourced. Initial growth of the business would be slow, but over time profits from each stage could fund the next stage. Alternatively, a big company or venture fund might pour a large amount of money into the same idea, helping it to grow more quickly. It might build a factory and begin aggressive marketing, spending tens of millions of dollars before the first dollar of revenue is generated.

Now suppose a quant comes in and models the process to determine an optimal schedule to supply capital to this business. Too little capital guarantees failure because at each stage the business must succeed in order to generate capital for the next stage. An unbroken run of successes is virtually impossible, even if you start with a great idea. The business needs to be able to survive setbacks, and possibly to run at a loss for a period, both of which require capital. However some businesses with inadequate capital will have substantial runs of success. These will be flashes in the pan, overnight sensations followed by spectacular busts.

Too much capital can insulate a business from the selection pressure needed to evolve and, in any event, will be wasted. So in principle-and I believe in practice-it is possible for a quant to come up with an optimal schedule for supplying capital to a business venture.

The government has a different perspective on the problem. It doesn't like companies failing and leaving unpaid liabilities. It might decide business ideas must be funded by a minimum amount of capital so that suppliers and employees (not to mention taxes) are paid in full if the idea doesn't work. We could imagine regulators seizing on the calculations done by quants, and insisting businesses have equity capital at least equal to the optimal level.

Before going any farther, note that the government concern is legitimate, although largely self-created. In a free market, potential suppliers and employees will consider the businesses prospects and either go elsewhere or demand terms that compensate them for the risks. If a business fails, the losses are allocated among people who took on the risks willingly.

Of course, we don't have a completely free market. The government likes to help voters. So it pays unemployment benefits and takes on liabilities for some pensions. It makes loan guarantees for politically favored businesses. Money for these programs comes from taxes levied on successful businesses.

Regardless of whether you think we have too much or too little of these sorts of things, the fact is that we do have them and they induce moral hazard on the part of the business. If the government is willing to stick successful businesses with some of your losses, you can take risks in which you get the profits while losses are paid by others. This creates the need for the government to limit the amount of risk you take. One simple way to do that is to demand minimum capital levels, and liquidate businesses that fall below the minimum when there are still enough assets to pay all creditors in full.

Notice that the quant and the government are concerned with entirely different kinds of capital. The quant considers what level of capital will drive optimal real business decisions. The regulator wants a pool of unencumbered assets to make sure the venture can cover any losses it incurs. There's no reason to expect these amounts to be the same, or even similar. The regulatory amount must be real money, but it doesn't matter whether the people running the business know it exists (in fact, it's safer for creditors if they don't). The essential thing for quant capital is that the people running the business think it exists, it doesn't matter whether it's real or not.

The biggest difference between quant capital and regulatory capital is that the latter has a diversification benefit. From a quant perspective, you want each individual business to make the right risk decisions. If no individual business has a disaster, the institution will be fine. Businesses will be run the same way whether they are independent or part of large organizations. This situation generally favors smaller companies because you save the layers of management above the day-to-day decisions.

A regulator thinks large companies with many risk-taking businesses need less capital than the same businesses considered as stand-alone entities because the individual business lines are not likely to all fail at the same time. So companies will grow in size in order to use capital more efficiently. But the individual business units will each be undercapitalized, thus they will expand too aggressively after successes and cut back too deeply after failures, and suffer too much volatility drag. Most businesses will fail, even if the underlying ideas are good. A few will get very large before failing. When a very large business unit fails, taking with it the reputations of its managers who have been propelled to high positions in the overall company, there can be the disaster regulators wanted to prevent. The capital set aside to cover losses will be inadequate because most of it will be in the form of business value of the large risk-taking business unit that failed.

The regulators' conception of the problem led them to focus on the overall equity capital of the institution rather than the dynamic behavior of the institution's risk takers. But the overall institution may seem okay while each individual risk taker is pursuing a strategy certain to blow up. Institution-wide constraints do not change individual behavior. While there were attempts to push capital charges to lower organization levels, these were much too crude to induce proper risk-taking behavior.

The result was regulator-used tools intended to enforce discipline in individual businesses to determine how much institution-level capital was needed to pay for the inevitable losses when individual businesses blow up. This institution-level capital was inadequate because, according to the regulatory view, you got a diversification benefit from combining businesses. If you had 25 independent traders, for example, you needed only five times the capital as if you had one trader. This makes sense if you're thinking of standard deviation and the probability of large overall losses. But it's incorrect if you're thinking of variance (standard deviation squared), which is what determines whether blow up is impossible for any unit or inevitable for all units.

The purported benefits of diversification meant that risk takers in a large financial institution could take far more risk per dollar of equity than independent traders. Regulation actually encouraged them to follow strategies that had to lead to ruin. Not all of them did, of course, but regulation made it easier than it otherwise would have been. A consequence of this behavior is that some risk takers have phenomenal runs of success, gaining institutional power in the process, and inflating the institution's reported capital with assets that are real enough at the time, but guaranteed to disappear suddenly. To make matters worse, institutions pursued similar strategies, so they blew up at the same time.

In finance, this was a pervasive misunderstanding. Regulations led to creation of huge risk management bureaucracies in banks, staffed mostly by people with no experience in taking risks. These organizations encouraged undercapitalized risk taking-overreaction to short-term gains and losses. They insisted on an equity cushion for losses that was going to disappear any time it was needed. If there is a quant culprit to the financial crisis, this is the quantitative misunderstanding that killed us.

What about the future? I don't see any fundamental reappraisal of regulatory theory going on either among academics or practicing regulators. On the other hand, many of the specific changes will work in the right direction. Financial institutions will be required to hold more capital (in the regulator's sense of the word), and the largest ones will have to hold extra. One major risk-taking business, proprietary trading, will be severed from US financial institutions. There have been technical adjustments to tools that result in smaller capital reductions for diversification. Depending on the implementation details, these changes may result in better capital allocation (in the quant sense) to individual risk takers. Nothing else will help; you cannot manage risk from the top down. If your line risk takers are running strategies certain to blow up, your institution cannot be saved by top management or regulators.

If the regulatory changes work, or if market forces prevail despite regulations, I predict we will see smaller, simpler financial businesses replace the gigantic global institutions created in the late 1990s, which have never enjoyed two successive years without a major crisis. These institutions will have to manage risk in the quant sense, or they will blow up and disappear from the gene pool. The benefits to the economy of efficient, effective, innovative, honest, and risk-controlled financial institutions are immeasurable.

On the other hand, it seems equally likely to me that the regulatory changes will merely prop up undercapitalized and overcomplex financial institutions until the next crash. In that case, the misunderstanding that nearly killed the financial system in 2008 may complete the job.

Unidentified bodies, missing cases mount in Mexico

(AP) ? After police found 49 dismembered bodies strewn on a Mexican highway leading to the Texas border, it took the army just a week to parade an alleged drug trafficker before journalists as the man who purportedly oversaw the body dump.

Yet two months after the grisly discovery in Nuevo Leon state, authorities have not identified a single victim.

The 49 bodies now appear headed for an increasingly common fate in this drug war-wracked country: They could join the growing ranks of the unidentified dead.

That group has become legion as nearly 16,000 bodies remain unidentified, says the National Human Rights Commission, an independent government agency. In total, 24,000 people have been reported missing. Many say the country's police are simply overwhelmed by the number of drug war casualties as they struggle with poor forensic capabilities and the reluctance of some witnesses and victims' relatives to help.

That apparent futility is drawing increasing criticism from Mexicans weary of the government-led offensive against drug cartels, who are also fighting among themselves. The violence in total has claimed at least 47,000 victims since President Felipe Calderon launched his anti-cartel campaign in late 2006.

"The level of violence we're living with reflects the critical condition our institutions are in, and it reveals a corrupt government," said Blanca Martinez of the Fray Juan de Larios human rights center in the northern border state of Coahuila. Hundreds of people have gone missing in Coahuila since 2009, when violence started to erupt in northeastern Mexico.

The most recent discovery of corpses shows just how hard it is to put names to often heavily mutilated bodies.

Although the 49 corpses all lacked heads, hands and feet, police performed DNA tests on them and compared the results, without luck, to hundreds of Mexicans reported missing.

The authorities captured Daniel Elizondo, the alleged cell leader for the hyper-violent Zetas drug cartel, and pinned the atrocity on him. But he and two other suspects arrested in the case apparently haven't offered any information that could help investigators. The army has said Elizondo claims he was given the bodies by someone else.

The bodies of the 43 men and six women remain at a morgue in the industrial city of Monterrey where they're marked "N.N." ? the Spanish initials for "No Nombre," or No Name. They've also been given numbers as IDs, a state police spokeswoman said. Authorities believe the bodies were signs of yet another battle between the Zetas and their rival Gulf and Sinaloa cartels.

Now it's up to the lead investigator to decide how long the bodies will remain at the morgue before they're wrapped in blankets and buried side by side in common graves in cemeteries throughout Monterrey's metropolitan area, said the police spokeswoman, who would not allow her name to be used under official policy. The bodies can stay in the morgue for a maximum of four months. By custom, Mexicans usually bury their dead within 48 hours.

Anguished relatives of the missing said they suffer in limbo awaiting any information about their loved ones.

"When they took my son, they destroyed me," said Maximina Hernandez, a 44-year-old maid from the Monterrey suburb of Santa Catarina whose police officer son was taken by gunmen minutes after ending a work shift in 2007. "The only thing I ask God is for some news, to know where he is. But there is no progress; there is nothing."

Hernandez has joined other people with missing relatives to push authorities to investigate the cases but said she's been disappointed by the results so far.

She said police took DNA samples from her and her son's father but never followed up on her suspicion that her 23-year-old son's commander was involved in his disappearance. Last year, authorities detained the police commander along with more than 40 Santa Catarina police officers for allegedly working for the Zetas.

Luis Garcia, an investigator with the National Human Rights Commission, said the number of unidentified bodies continues to grow, as has the number of missing persons. The commission listed 8,898 unidentified bodies from 2000 to 2005; that number had since jumped by 80 percent as of June. The number of missing people reported in the earlier period, 5,397, has grown even more dramatically, by nearly 350 percent.

No one knows exactly how many of those unidentified bodies were killed in drug-related violence or how many people are missing at the hands of cartels because such a study has never been done, Garcia said.

"There needs to be an investigation in each case, to put a first and last name (on each victim) so that there is no impunity," he said. "The issue here is that there is no effective investigation."

Government efforts to tackle the monumental problem have produced mixed results. Calderon has tried to reform and professionalize the federal police force, which has tripled in manpower to 35,000 officers, but has had little success improving local and state forces. The government proposed creating a national database with information on missing persons that could be accessed by investigators in all 32 states but is still trying to get it up and running.

Crime victim relatives have long complained that requests for help are often ignored and say it's not uncommon for them to be harassed to stop pushing for an investigation.

Unlike Nuevo Leon, the majority of Mexico's 32 states don't even have the technology to do DNA profiles, and few investigators are trained on how to process a crime scene.

In many cases, overwhelmed police have to identify dozens of bodies, dumped in abandoned mine shafts, left in the middle of busy avenues or buried in mass graves.

In Durango state, authorities found five bodies in a clandestine mass grave in mid-July, raising the total of corpses unearthed in the state since April 2011 to 336, said state prosecutor Sonia de la Garza. More than 600 families have turned over DNA samples to state authorities, who have to send them to neighboring Chihuahua state for processing.

Police around Durango initially were using backhoes to dig out bodies from mass graves before investigators intervened because that was destroying evidence.

"The fact that so many bodies remain unidentified tells you about the enormous scale of the violence in some parts of the country where the cartels have fought each other and also ravaged the civilian population in the process," said Andrew Selee, director of the Mexico Institute, a Washington-based think tank.

The widespread corruption among Mexico's police, particularly in small local forces, complicates identifications. As a result, many people with missing relatives don't approach authorities out of fear of being targeted should the officers be in collusion with criminals.

Hernandez said state investigators once told her they were afraid to look into the disappearance of her son, Jesus Everardo Lara Hernandez, because it was a "tough situation."

"They told me to understand them because they, too, had families." Hernandez said.

Hernandez, who has three other children, ages 7 to 14, said she was petrified when her son was taken, but her drive to find him was stronger and she began her own investigation and talked to her son's colleagues.

"It was very difficult because I stopped paying attention to my little ones to be able to look for him," she said. "It has been a horrible five years, but the hope of finding him keeps me strong."
